When you have been fired from your job and you believe that you were fired wrongfully, it can be a frustrating and anger-inducing experience. It is important, however, to make sure that you keep calm and take logical action for the sake of your future.
You should first of all take your time to consider the reasons why you believe that you were wrongfully terminated. If you are to have a successful claim against your employer for wrongful termination, you must be able to identify the reasons in a coherent way. There are four main situations when a person could be wrongfully terminated from his or her job.
Discrimination
If you believe that you were fired because of a discriminatory reason such as your gender, race, age or disability, this would count as wrongful termination. However, you should be able to have some type of evidence of this.
Harassment
Similarly, if you were harassed at work, either sexually or in the form of bullying or intimidation, it is illegal to be fired as a consequence.
Retaliation
If you recently made a complaint, you have protection from being fired in order to prevent workplace retaliation from occurring.
Contract breach
If you have a written contract, your firing may have been in breach of this. Make sure that you read the small print and understand all of the terms.
There are many ways that it could be proven that you were wrongfully terminated from your job. It is important that you document all events that took place, and compile any evidence that you have been able to collect.
