GEL Partner, Cori Cohen, will be presenting at the 2023 DC Bar’s Changing Current CLE on impacts of the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act. The forthcoming presentation titled, A Matter of Definition: Sexual Harassment and the Arbitrability of Workplace Disputes, Ms. Cohen will discuss the new law’s impact on pre-dispute arbitration agreements, the key legal definitions, and the interplay between State and Federal Law. The topic is particularly pertinent because an estimated 60 million Americans are subject to mandatory arbitration clauses and between 50-75% of women have faced unwanted or unwelcome sexual harassment in the workplace. The ability for women to waive forced arbitration clauses and publicly litigate their claims in court, and the way courts interpret the law going forward, will have ripple effects throughout the employment law field.
